DOT ID Terms of Use

DRAFT. This text has not yet been approved by the owner and has no legal effect; no consent is collected on it. Places in square brackets are to be filled in.

Version 1.0 (draft)

These Terms of Use (the "Terms") are concluded between "DOT" Limited Liability Company ("DOT" MMC, VÖEN 1700516571, Republic of Azerbaijan, 79 Ismayilbey Gutgashinli St., apt. 24, Yasamal district, Baku AZ1073; "DOT") and the natural person who creates or uses a DOT ID account (the "User", "you"). The Terms are a public offer within the meaning of Article 409 of the Civil Code of the Republic of Azerbaijan; creating an account constitutes full and unconditional acceptance of the Terms.

1. Subject

1.1. DOT ID is a single-account service for the products of the DOT ecosystem (the "products"): sign-in to products, storage of contact details, addresses and payment methods, identity verification, representation of companies, notifications and support.

1.2. DOT ID is provided to the User free of charge. Paid services are provided by products on their own terms; DOT ID only stores the payment method and passes it to a product on your action.

1.3. Each product is a separate service with its own terms and privacy policy. DOT is responsible for DOT ID; the operator of a product is responsible for that product, even where that operator is also DOT or an affiliate, to the extent of that product's terms.

2. Account

2.1. An account may be created by a natural person aged 16 or over. Identity verification and product services that require the age of majority are available from 18. One person — one account. The account is personal and may not be transferred to another person.

2.2. The user name is an e-mail address. It must belong to you and be confirmed through the link in the e-mail. Addresses of non-existent domains and of disposable e-mail services are not accepted.

2.3. You must provide accurate data and keep it up to date. Your first and last name must match your identity document; they are compared during identity verification.

2.4. The DOT ID number is assigned by the system on first use and does not change. It is a convenient reference to the account and by itself does not confirm identity.

3. Security

3.1. You are responsible for keeping your password, passkeys, recovery codes and the devices you sign in from secure. All actions taken after signing in to your account are deemed yours until you report a compromise.

3.2. You must report any suspected unauthorised access immediately through "Support". Where there are signs of compromise, DOT may require a second factor or a fresh sign-in, or temporarily restrict operations.

3.3. Certain operations (changing sign-in methods, revealing document data, acting on behalf of a company) require a recent sign-in with a second factor. DOT staff never ask for passwords or codes.

3.4. Attempts to bypass security measures, automated registrations, password guessing, interference with the service and use of DOT ID to access other people's data are prohibited.

4. Identity verification

4.1. Identity verification is voluntary and takes place on the basis of a separate consent. Without it the account works, but some product functions (for example company representation or services requiring the age of majority) may be unavailable.

4.2. Verification is performed automatically with the involvement of an identity verification provider; the result may be reviewed on your request. DOT does not guarantee a positive result and may refuse verification where discrepancies are found.

4.3. A result obtained in test mode (synthetic data) is not an identity verification and is marked as a test result.

4.4. Presenting another person's, forged or invalid documents is prohibited. Such actions lead to the blocking of the account and may be reported to law enforcement.

5. Companies and representation

5.1. You may add a company by its VÖEN and declare your authority as its representative. The name and address from the state register are pre-filled as a hint and do not confirm authority.

5.2. Authority is confirmed by documents and by a decision of DOT or of an authorised product; confirmed authority may be revoked where discrepancies are found. You are responsible for the accuracy of the declared authority and for actions taken on behalf of the company in products.

5.3. Removing a company from "My companies" affects only your link to it; records of other representatives do not change.

6. Payment methods

6.1. A bank card is linked on the secure page of a payment service provider (Yığım, Epoint). DOT ID does not receive the full card number or the CVV and stores only a technical reference to the card, the masked number and display details.

6.2. Linking a card in DOT ID is not a payment. Payments are initiated by products on your instruction under the terms of the product and of the payment service provider; refunds are governed by the product.

6.3. You may use only cards you lawfully hold. A card linked in test mode is marked as a test card and is not used for real payments.

7. Products and data sharing

7.1. When you sign in to a product with DOT ID, the product receives your identifier, name and verified e-mail address. Phone, addresses, company data and the identity verification result are passed only on your explicit action; document photos are never passed to products.

7.2. You may end your sessions in all products at any time ("Sign out everywhere"). A product subscribed to DOT ID events is notified of sign-out, blocking and account deletion.

7.3. A product of which you are already a user may look up your account by an exact verified contact or by your DOT ID number to add you to its workspace; you will be notified.

8. Notifications

8.1. Service messages (address confirmation, codes, security warnings, notices of changes to the terms) are part of the service and are sent to your verified address and number; they cannot be opted out of without deleting the account. DOT ID sends no marketing.

9. Restrictions and blocking

9.1. DOT may restrict or block an account in case of a breach of the Terms, on a substantiated request of a competent authority, where there are signs of compromise or fraud, or where the account was created in breach of clause 2.1. You will receive an e-mail about the block; it can be appealed through "Support".

9.2. DOT may suspend the service for maintenance, striving to minimise downtime and to give advance notice where possible.

10. Account deletion

10.1. You may request deletion under "Settings". Within 30 days the request can be cancelled by signing in. After that period the account and its data, including identity verification data and photos, are erased irreversibly; products are notified of the account's termination.

10.2. Deletion may be postponed where a product in which you have outstanding obligations reports this within the deletion protocol; you will see the reason in the cabinet.

10.3. Data whose retention is required by law (for example accounting records) is kept for the statutory periods to the extent necessary for those purposes.

11. Intellectual property

11.1. DOT ID, its software, trade marks and design elements belong to DOT or are used under licence. The Terms grant no rights to them other than the right to use the service as intended.

12. Liability

12.1. DOT ID is provided "as is" to the extent permitted by the legislation of the Republic of Azerbaijan. DOT is liable for direct damage caused through its fault and is not liable for the actions of products, payment service providers and other third parties, for the consequences of your loss of access credentials, or for inability to use the service for reasons beyond DOT's control.

12.2. Nothing in the Terms limits the rights granted to you by the Law of the Republic of Azerbaijan "On Protection of Consumer Rights" and other legislation that cannot be limited by contract.

13. Changes

13.1. DOT may amend the Terms. You will be notified of material changes at least 30 days in advance in the cabinet and by e-mail. If you disagree with the changes you may delete the account before they take effect; continued use after that date means acceptance of the new version.

14. Governing law and disputes

14.1. The Terms are governed by the law of the Republic of Azerbaijan.

14.2. Disputes are resolved by negotiation through "Support" or at DOT's address; a claim is answered within 10 working days. Failing agreement, the dispute is submitted to the court at DOT's location, unless mandatory consumer-protection legislation provides otherwise.

15. Miscellaneous

15.1. The Terms are published in Azerbaijani, Russian and English; in case of discrepancy the Azerbaijani version prevails.

15.2. Invalidity of a single provision does not invalidate the Terms as a whole.

15.3. The Privacy Policy and, where identity is verified, the Consent to processing of identity verification data form an integral part of the Terms.
